H-1B petitions for fiscal year 2005-2006 now accepted for processing by CIS

April 1, 2005

The United States Citizenship and Immigration Services (CIS) is now accepting H-1B petitions for new employment for all employers for the new fiscal year which runs from October 1, 2005 until September 30, 2006. 65,000 H-1B visas are allocated each fiscal year. CIS has been promising to release an additional 20,000 visas for the remainder of this fiscal year. You will recall that this year's H-1B visa cap was reached on the first day of this fiscal year, October 1, 2004. However, nothing has yet been published in the federal register. We are monitoring developments on a daily basis and will keep you posted as soon as we know.

Please note that new prevailing wage regulations went into effect on March 8, 2005, now requiring that the employer pay 100% of the prevailing wage, with salaries calculated according to new formulas.
